                   	     ORDINANCE NO. 10578
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING AN ALLEY
                   LOCATED SOUTHWEST FROM KIRBY AVENUE, NORTHWEST
                   OF KYLE STREET, MORE PARTICULARLY DESCRIBED
                   HEREIN, UPON CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned an alley located southwest from Kirby Avenue,
         northwest of Kyle Street, more particularly described herein, 
and
         as shown on plat attached hereto and made a part hereof by 
refer-
         ence:
                A 12 foot wide alleyway beginning on the southwest
                line of Kirby Avenue 150 feet northwest of the
                intersection of the southwest line of Kirby Avenue
                with the northwest line of Kyle Street, and
                extending southwest 438.6 feet between parallel
                lines, and parallel to Kyle Street, to the
                northeast line of Anderson Avenue.  Said alleyway
                separates lots 82-90, Carey's Addition to
                Ridgedale, as shown by plat of record in plat book
                1, page 38, ROHC, from lots 3 and 4, Wright's
                Subdivision of Lots 91-99, Carey's Addition to
                Ridgedale, as shown by plat of record in plat book
                6, page 2, ROHC.  Tax Map No. 156C-E-10, and
                156C-F-18, 22, and 25.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
                1. The City of Chattanooga has a catch basin
                   located within the right-of-way.  This catch
                   basin and a section of the alley on the south
                   end, large enough to allow entry of vehicles
                   into the residence at the southeast corner of
                   the alley, shall be kept outside the closure
                   area.    
               
                2. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                3. All existing easements are retained.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
